These Terms of Use (“Terms”) govern your use of the Color Moments mobile application and website. By using Color Moments, you agree to these Terms.
1. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use Color Moments on devices you own or control for personal, non-commercial entertainment.
2. Permitted use
You may use the app’s coloring features and built-in pictures as provided. You may not reverse engineer, redistribute, rent, sell, sublicense, interfere with, or attempt to gain unauthorized access to the app, except where applicable law expressly permits such activity.
3. Artwork and app content
The app, website, illustrations, visual elements, software, and other content are owned by us or our licensors and are protected by intellectual-property laws. Completing a picture does not transfer ownership of the underlying artwork or grant commercial reuse rights.
4. App availability and changes
We may improve, update, suspend, or discontinue features or content. We do not promise that every picture or feature will always remain available, or that the app will operate without interruption on every device or operating-system version.
5. Advertising and third-party services
Color Moments may include advertisements or links to third-party services. We are not responsible for third-party content, availability, products, or practices. Your use of those services may be governed by separate terms and privacy policies.
6. Privacy
Our Privacy Policy explains how information is handled and forms part of your use of Color Moments.
7. Disclaimer
To the maximum extent permitted by law, Color Moments is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, we and our licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, use, or profits arising from your use of or inability to use Color Moments. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
Your license ends automatically if you materially violate these Terms. When it ends, you must stop using and remove the app. Provisions that by their nature should survive termination will remain in effect.
10. Platform terms
If you obtain Color Moments through Apple’s App Store, your use is also subject to the Apple Standard EULA. If these Terms conflict with mandatory platform terms, the mandatory platform terms control to the extent of the conflict.
11. Changes to these Terms
We may update these Terms from time to time. The effective date above identifies the latest version. Continued use after an update means you accept the revised Terms where permitted by law.
